These terms apply to the Word Bites app, published by John Arana. By downloading or using the app, you agree to them. If you do not agree, please do not use the app.
Your licence to use the app
We grant you a personal, non-exclusive, non-transferable licence to install and use Word Bites on devices you own or control, for your own non-commercial enjoyment. You may not copy, sell, rent, sublicense, or redistribute the app, reverse engineer it, or attempt to extract its source code or puzzle data, except where that restriction is prohibited by law.
In-app purchases
Word Bites offers optional in-app purchases. All purchases are processed by Apple through the App Store, and they are governed by Apple's terms as well as these.
- Prices are shown before you confirm a purchase and may change over time.
- Purchased items are a licence to use a feature within the app. They have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.
- Refunds are handled by Apple, not by us. Requests go through reportaproblem.apple.com. We are happy to help if something went wrong, but we cannot issue a refund ourselves.
- If you delete and reinstall the app, use the restore purchases option to recover previous purchases.
Availability and changes
We may update, change, or discontinue the app or any of its features at any time. We try not to remove things people rely on, but we cannot guarantee that the app will always be available, or that it will continue to work on future devices or operating system versions.
Your content and conduct
Word Bites does not include accounts or user-submitted content. If you contact us, please keep it civil, and do not send us anything you do not have the right to share.
Ownership
The app, its name, artwork, puzzles, and design are owned by John Arana and are protected by copyright and other laws. These terms do not transfer any ownership to you.
No warranty
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, John Arana will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising out of your use of the app. Where liability cannot be excluded, it is limited to the greater of the amount you paid for the app and its in-app purchases in the twelve months before the claim, or ten US dollars.
Some jurisdictions do not allow certain exclusions or limitations, so parts of the two sections above may not apply to you. Nothing in these terms limits rights you have under mandatory consumer law.
Apple
Apple is not a party to these terms and has no obligation to provide support for the app. Apple is not responsible for the app or for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Privacy
Our handling of information is described in the Privacy Policy. In short, Word Bites has no accounts and no server of ours, gameplay is offline, and the only information that leaves the app is the install and session events sent to Meta to measure advertising effectiveness.
Termination
You may stop using the app at any time by deleting it. We may suspend this licence if you materially breach these terms.
Changes to these terms
If these terms change, we will update the date at the top of this page. Continuing to use the app after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Oregon, United States, without regard to its conflict of law rules, except where local consumer protection law requires otherwise.
